Terms of Service

These Terms of Service ("Terms") govern your access to and use of Clarvi, an AI-powered fashion and product photography application available at clarvi.app. The Service is operated by Gustavo Adolfo Moreno Cubaque, an individual sole proprietor based in Villavicencio, Colombia ("Clarvi", "we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using Clarvi you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. The Service is not directed to and may not be used by minors.

2. The Service

Clarvi lets you upload images (such as garments, products, and model photographs) and uses artificial intelligence to generate new images. Outputs are generated automatically and may not always be accurate, realistic, or suitable for your intended use.

3. Accounts

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly of any unauthorized use.

4. Subscriptions, Credits, and Billing

Clarvi is offered through monthly and annual subscription plans, plus optional one-off credit top-ups. Each subscription grants a number of credits used to generate images. Pricing and credit allocations are those displayed at the point of purchase.

How credits work. Credits are not money, are not transferable, and have no value outside the Service. They fall into three types:

• Subscription credits are granted for the current billing cycle and do not roll over. At each renewal the subscription balance is replaced, so any unused subscription credits from the previous cycle are lost.
• Permanent credits (such as your sign-up bonus, referral rewards, and one-off top-ups) do not expire while your account is open.
• Weekly free credits on the free tier are replaced each week and do not accumulate.

On annual plans you pay for the year upfront, but credits are granted month by month, and each month's subscription grant expires at the start of the next cycle. We do not release the full year of credits at once. Full details are on our pricing page.

Payments and merchant of record. Orders and payments for the Service are processed by Paddle.com Market Limited ("Paddle"), our authorized reseller and merchant of record. When you purchase a subscription, your contract for the purchase is with Paddle, and Paddle handles all payment transactions, billing, invoicing, applicable sales tax/VAT, and payment-related inquiries. Your use of Paddle's checkout is also subject to Paddle's own terms and privacy policy. Refunds are handled in accordance with our Refund Policy together with Paddle's policies.

Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. You may cancel at any time; cancellation stops future renewals and takes effect at the end of the current paid period.

5. Acceptable Use Policy

You are solely responsible for the images you upload and the images you generate. You agree not to use the Service to:

• Upload photographs of any individual without that person's explicit consent.
• Generate, modify, or distribute images of real, identifiable people without their authorization, including impersonation, "deepfakes", or any depiction intended to deceive.
• Create sexual, pornographic, sexually suggestive, or otherwise NSFW content.
• Upload, generate, or attempt to generate any content that depicts, sexualizes, or is directed at minors. This is strictly prohibited without exception.
• Produce content that is defamatory, harassing, hateful, or that promotes violence or discrimination.
• Infringe the intellectual property, privacy, or publicity rights of any third party.
• Use outputs for fraud, scams, misinformation, or any unlawful purpose.
• Attempt to reverse engineer, scrape, overload, or circumvent the technical limitations of the Service.

We may suspend or terminate accounts that violate this policy, with or without notice, and may remove offending content.

6. Your Content and Licenses

You retain ownership of the images you upload. You grant Clarvi a limited, non-exclusive license to host, store, and process your uploaded images solely for the purpose of operating the Service and generating your requested outputs. We do not use your uploaded or generated images to train AI models, and your content is kept private to your account, as described in our Privacy Policy.

You represent and warrant that you own or have all necessary rights, consents, and permissions for every image you upload, and that your use of the Service does not violate any law or third-party right.

7. Generated Images

Subject to your compliance with these Terms, you may use the images you generate with Clarvi, including for commercial purposes such as e-commerce listings and marketing. You are responsible for ensuring that your use of any generated image is lawful and does not infringe third-party rights. We make no representation that AI-generated images are eligible for copyright protection in any jurisdiction.

8. Intellectual Property

The Service, including its software, models, design, and trademarks, is owned by Clarvi and protected by applicable laws. These Terms do not grant you any right in the Service other than the limited right to use it as permitted here.

9. Third-Party Services

Image generation is performed using third-party AI infrastructure, primarily Fal.ai, which may route your request to the underlying model providers it hosts (for example OpenAI and Google). Payment processing is provided by Paddle. Your use of the Service involves the processing of your data by these providers as described in our Privacy Policy.

10. Refunds

Refunds are governed by our Refund Policy, available at clarvi.app, and are processed through Paddle as merchant of record.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if required to protect the Service or other users. Upon termination, your right to use the Service ceases and your content may be deleted in accordance with our Privacy Policy.

12. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated images will meet your expectations.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Clarvi and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total aggregate liability arising out of or relating to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the event giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Clarvi and its operator from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or any law or third-party right.

15. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the Republic of Colombia, without regard to conflict-of-law principles. Any dispute shall be subject to the competent courts of Villavicencio, Colombia, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
