This Privacy Policy explains how Gustavo Adolfo Moreno Cubaque, an individual sole proprietor based in Villavicencio, Colombia ("Clarvi", "we", "us", "our"), collects, uses, and protects your personal data when you use Clarvi, an AI-powered fashion and product photography application. We act as the data controller for the personal data described below. By using the Service, you agree to this Policy.
1. Data We Collect
Account data. Your name, email address, and authentication details when you create an account. Sign-in and account management are provided through our authentication provider.
Images you upload. Photographs you upload to generate images, such as garments, products, and model photos.
Generated images. The images produced by the Service at your request.
Usage data. Technical and usage information such as device type, app interactions, log data, and credit consumption, used to operate and improve the Service.
Payment data. Payments are processed by Paddle as merchant of record. Paddle collects and processes your billing information directly. We do not receive or store your full card details; we receive only limited transaction information needed to manage your subscription.
2. How We Use Your Data
We use your data to: provide and operate the Service; generate the images you request; manage your account, subscription, and credits; provide customer support; maintain security and prevent abuse; and comply with legal obligations.
3. How We Handle Your Images
Your privacy regarding images is central to Clarvi:
- Private to your account. Uploaded and generated images are associated only with your account. They are not shared with other users or made public by us.
- No model training. We do not use your uploaded or generated images to train, fine-tune, or improve any AI model.
- Processing only to serve you. Your images are processed solely to generate the outputs you request.
Retention of images:
- Free accounts: generated images are retained for 30 days and then deleted.
- Paid accounts: images are retained for as long as your subscription remains active.
- If a paid plan lapses (cancellation or downgrade), we keep your generated images for a 60-day grace period so you can export them, after which the free 30-day rule applies going forward.
- Dormant free accounts: if a free account has no activity for 12 months, we send reminders and then delete the account and its data.
You can delete your images or request account deletion at any time (see Section 7). Deleting your account purges your images immediately.
4. Third Parties and Sub-Processors
We share data only with service providers who help us operate Clarvi, under appropriate confidentiality and data-protection obligations:
- Fal.ai (United States): provides the AI infrastructure that generates images. Your uploaded images are transmitted to Fal.ai solely to produce your requested outputs. Fal.ai may route the request to the underlying model providers it hosts (for example OpenAI and Google).
- Paddle.com Market Limited (Paddle): our merchant of record, which processes payments and billing.
- Authentication provider: manages account sign-in and credentials.
- Cloudflare R2 (object storage): securely stores your uploaded and generated images.
- Email provider: sends transactional and account emails.
- Hosting and infrastructure providers: used to host the application and store data securely.
We do not sell your personal data, and we do not share it with third parties for their own marketing purposes.
5. International Data Transfers
Because some of our providers (including Fal.ai and Paddle) are located outside Colombia, including in the United States, your personal data may be transferred internationally. Where required, such transfers are carried out under appropriate safeguards, such as standard contractual clauses or equivalent mechanisms, in accordance with applicable data-protection law.
6. Data Retention
We retain account and usage data for as long as your account is active and as needed to provide the Service. We retain certain data longer where required to comply with legal, accounting, or security obligations. Image retention is as described in Section 3.
7. Your Rights
Depending on your location, you may have the right to access, correct, update, delete, restrict, or object to the processing of your personal data, to data portability, and to withdraw consent. These rights apply under the EU/UK GDPR, the California Consumer Privacy Act (CCPA), and Colombia's Law 1581 of 2012, among others.
To exercise any right, contact us at support@clarvi.app. We will respond within the timeframes required by applicable law. You also have the right to lodge a complaint with your local data-protection authority (in Colombia, the Superintendencia de Industria y Comercio).
8. Children's Privacy
The Service is intended only for users aged 18 and over. We do not knowingly collect personal data from minors. If we learn that we have collected data from a minor, we will delete it.
9. Security
We implement reasonable technical and organizational measures to protect your data against unauthorized access, loss, or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Cookies and Analytics
Our website and app may use cookies and similar technologies for authentication, preferences, and analytics to understand and improve usage. You can manage cookies through your browser settings.
11. Changes to This Policy
We may update this Policy from time to time. We will update the "Last updated" date and, where appropriate, notify you of material changes.
